Welcome to The Crunchy Canine.

These Terms of Service govern your use of our website, dog-training services, facility, online resources, email communications and SMS text-messaging services.

By visiting our website, submitting an enquiry, booking an appointment, registering for a program, purchasing a service, renting our facility or otherwise using our services, you agree to these Terms.

Agreeing to these general Terms does not automatically provide consent to receive promotional emails or text messages. Promotional communications will be sent only where appropriate consent has been obtained.

1. Business Information

The Crunchy Canine Inc. provides professional dog-training and related services in Ontario, Canada.

Our services may include:

  • Private dog training
  • In-home dog training
  • Puppy training and socialization
  • Group obedience classes
  • Agility classes
  • Scent-detection classes
  • Day Camp
  • Dog-training facility rental
  • Online training and educational resources
  • Behaviour consultations
  • Related dog-training services

Service availability, schedules, locations and prices may change.

2. Eligibility

You must be at least 18 years old and legally capable of entering into an agreement to purchase or register for our services.

Anyone under the age of 18 may participate only with the permission and supervision of a parent or legal guardian where required.

By registering a dog, you confirm that you are the dog’s owner or have been authorized by the owner to make decisions concerning the dog.

3. Additional Agreements and Waivers

Certain services may require you to complete or accept additional documents, including:

  • Registration forms
  • Behaviour questionnaires
  • Client service agreements
  • Liability waivers
  • Day Camp agreements
  • Facility-rental agreements
  • Veterinary-information forms
  • Payment authorizations
  • Photography or video consent forms

These additional documents form part of your agreement with The Crunchy Canine.

Where a specific service agreement conflicts with these general Terms, the specific service agreement will apply to that service, except where applicable law provides otherwise.

Electronic acceptance, including selecting a checkbox, submitting an online form, providing an electronic signature or making payment, may constitute acceptance of the applicable agreement.

4. Information About Your Dog

You agree to provide complete, current and accurate information about your dog, including:

  • Age, breed and size
  • Health and medical conditions
  • Vaccination status
  • Injuries or physical limitations
  • Medications
  • Allergies or dietary restrictions
  • Behaviour around people and other animals
  • Fear, anxiety or reactivity
  • Biting or attempted biting
  • Aggression or resource guarding
  • Escape behaviour
  • Previous incidents
  • Any other health or safety concern

You must notify us promptly if your dog’s health, behaviour, medication or circumstances change.

Failure to disclose relevant information may place your dog, other animals, trainers, clients or members of the public at risk. We may suspend or discontinue services where important information has been withheld or where continuing the service would be unsafe.

5. Health and Vaccination Requirements

Dogs attending classes, Day Camp, facility rentals or other in-person services must meet the health and vaccination requirements communicated for the applicable service.

You must not bring a dog that:

  • Has a contagious illness
  • Has recently been exposed to a contagious illness
  • Has vomiting, diarrhea, coughing or unexplained discharge
  • Has fleas, parasites or another transmissible condition
  • Has an injury or medical condition that makes participation unsafe
  • Has been advised by a veterinarian not to participate

We may request proof of vaccination or veterinary clearance.

We reserve the right to refuse or postpone participation where we reasonably believe that a dog may present a health or safety risk.

You are responsible for consulting your veterinarian regarding whether your dog is medically fit to participate.

6. Training Results

Every dog is different, and training outcomes cannot be guaranteed.

Results may be affected by:

  • The dog’s age, health, temperament and history
  • The type and duration of the behaviour
  • The owner’s participation
  • Consistency between sessions
  • The frequency of practice
  • The training environment
  • Other people or animals in the household
  • Circumstances outside our control

The Crunchy Canine does not guarantee that a particular behaviour will be completely corrected or that a specific result will be achieved within a particular period.

You agree to follow reasonable training instructions and practise recommended exercises consistently and safely.

7. Training Methods and Equipment

Training methods and equipment may be selected according to:

  • The dog’s individual needs
  • The dog’s health and behaviour
  • The training objective
  • The service being provided
  • Information supplied by the owner
  • Safety and welfare considerations

You are responsible for:

  • Following instructions regarding equipment
  • Checking equipment before use
  • Ensuring collars, harnesses and leashes fit properly
  • Reporting discomfort, injury or adverse reactions
  • Not using equipment in a harmful or unauthorized manner

You should contact us before making significant changes to a training plan involving behavioural or safety concerns.

8. Bookings and Availability

Appointments, classes, consultations, Day Camp spaces and facility-rental times are subject to availability.

Submitting an enquiry or registration form does not guarantee a booking.

A booking is confirmed only when:

  • The Crunchy Canine confirms the date, time and service; and
  • Any required payment, deposit, registration form or waiver has been received.

You are responsible for reviewing booking confirmations and ensuring that the date, time, location and service are correct.

9. Prices and Taxes

Prices may be displayed on:

  • Our website
  • A booking page
  • A registration form
  • An invoice
  • A quotation
  • A service agreement
  • Written communication from our team

Unless otherwise stated, all prices are in Canadian dollars and are subject to applicable taxes.

We may update prices for future bookings. A price change will not normally affect a confirmed and fully paid service unless agreed by the client or permitted by law.

Additional charges may apply for:

  • Travel outside our regular service area
  • Additional dogs
  • Additional sessions
  • Extended appointment time
  • Late pickup
  • Excessive cleaning
  • Property or equipment damage
  • Special arrangements requested by the client

Any reasonably foreseeable additional charge will be communicated before it is applied.

10. Payments

Payment may be required:

  • At the time of booking
  • Before the first appointment
  • Before a class or program begins
  • According to an agreed payment schedule
  • Upon receipt of an invoice

Accepted payment methods may include credit card, electronic transfer, online payment or another approved method.

You agree to provide accurate billing information and authorize us or our payment provider to process the applicable charges.

We may postpone, suspend or cancel services where payment has not been received by the required date.

11. Client Cancellations and Rescheduling

Cancellation and rescheduling policies may vary by service.

The applicable policy may be stated on:

  • The booking page
  • Registration form
  • Invoice
  • Confirmation message
  • Service agreement

Unless a different policy is provided, clients should give at least 48 hours’ notice to cancel or reschedule a private appointment.

Where insufficient notice is provided:

  • The session may be treated as used
  • A cancellation fee may apply
  • A deposit may be retained
  • A new payment may be required before rebooking

Emergency circumstances may be considered individually.

Nothing in this section removes a cancellation, refund or other right available under applicable consumer-protection law.

12. Missed Appointments

A client who does not attend a confirmed appointment without providing adequate notice may lose the appointment and any associated payment or session credit.

Repeated missed appointments, late cancellations or rescheduling requests may result in:

  • Future bookings requiring advance payment
  • Remaining services being placed on hold
  • Cancellation of future appointments
  • Refusal of further bookings

13. Group Classes and Programs

Registration reserves a place in a scheduled class or program.

Unless otherwise stated:

  • Missed classes are not automatically refundable
  • Makeup classes are not guaranteed
  • Registration may not be transferred without permission
  • Participants must follow trainer and facility instructions
  • Dogs must remain under the control of their handlers
  • Children must be appropriately supervised
  • Class schedules may change because of weather, instructor availability, facility issues or insufficient enrolment

Where a dog cannot participate safely in a group environment, we may recommend private training or another suitable service.

A recommendation to change services does not automatically create a right to a refund, except where stated in the applicable agreement or required by law.

14. Day Camp

Day Camp participation is subject to:

  • Availability
  • Assessment
  • Health requirements
  • Behavioural suitability
  • Completion of the applicable agreement

We may separate dogs, provide rest periods, modify activities or remove a dog from group participation where reasonably necessary for safety or welfare.

You must:

  • Provide accurate emergency-contact information
  • Remain reachable during the booking
  • Collect your dog at the agreed time
  • Disclose feeding, medication and medical requirements
  • Provide any required food, medication or equipment with clear instructions

Late-pickup fees may apply.

We may discontinue Day Camp services where continued participation is unsuitable or unsafe.

15. Medication and Veterinary Care

We will administer medication only where:

  • We have agreed to do so
  • Clear written instructions have been provided
  • The medication is properly identified and supplied

You authorize us to seek veterinary attention where we reasonably believe that immediate care is required and we cannot reach you or your emergency contact.

Where reasonably possible, we will attempt to contact:

  1. You
  2. Your emergency contact
  3. Your preferred veterinarian

In an urgent situation, we may contact the nearest available veterinary provider.

You remain responsible for veterinary expenses and related costs incurred for your dog, except where responsibility cannot legally be assigned to you.

16. Facility Rental

Facility renters must follow the separate facility-rental agreement and all posted or communicated rules.

Renters are responsible for:

  • Their dogs
  • Their guests
  • Maintaining control of animals
  • Cleaning up after use
  • Using equipment correctly
  • Preventing property damage
  • Leaving the facility in an acceptable condition
  • Reporting damage, injury or safety concerns
  • Ensuring unauthorized persons do not enter

Facility time may not be transferred, resold or used for unauthorized commercial activities without written permission.

Additional charges may apply for:

  • Late departure
  • Excessive cleaning
  • Missing equipment
  • Damage
  • Violations of rental conditions

17. Safety and Removal From Services

You must follow all reasonable instructions provided by our trainers or staff.

We may refuse, suspend or end participation where:

  • A dog creates an immediate or unmanageable safety risk
  • Relevant medical or behavioural information was not disclosed
  • Instructions are repeatedly ignored
  • A participant acts abusively, threateningly or dangerously
  • Payment remains overdue
  • Participation disrupts other clients or services
  • Facility rules are violated
  • Continuing the service would not be appropriate for the dog

Where reasonably possible, we will explain the reason and discuss alternative options.

Refund eligibility will depend on the circumstances, the services already provided, costs already incurred, the applicable agreement and legal requirements.

18. Risks Associated With Dogs

Working with dogs involves inherent risks, including:

  • Bites
  • Scratches
  • Falls
  • Collisions
  • Escape
  • Injury to people or animals
  • Damage to clothing or property
  • Exposure to illness or parasites
  • Unpredictable animal behaviour
  • Aggravation of an existing medical or behavioural condition

You acknowledge that even a trained dog may behave unpredictably.

You remain responsible for maintaining appropriate control of your dog except when the dog has been formally placed in our care.

You must immediately report any health, behavioural or safety concern.

19. Limitation of Liability

To the maximum extent permitted by law, The Crunchy Canine Inc. and its owners, trainers, employees, contractors and representatives will not be liable for indirect, incidental, special or consequential loss arising from the use of the website or services.

Where liability cannot legally be excluded, our liability will be limited to the amount paid for the specific service giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Separate liability waivers may apply to particular services and activities.

20. Client Responsibility

You are responsible for loss, injury or damage caused by:

  • Your dog
  • Your failure to disclose relevant information
  • Your failure to follow safety instructions
  • Your unauthorized use of the facility or equipment
  • The conduct of guests or other persons attending with you

To the extent permitted by law, you agree to reimburse The Crunchy Canine for reasonable losses, expenses or claims arising from your breach of these Terms or your negligent or unlawful conduct.

You are not responsible for loss caused by The Crunchy Canine where responsibility cannot legally be transferred.

21. Weather, Emergencies and Events Outside Our Control

Services may be delayed, moved, rescheduled or cancelled because of:

  • Severe weather
  • Unsafe travel conditions
  • Illness or injury
  • Power or internet outages
  • Facility problems
  • Public-health concerns
  • Government restrictions
  • Emergencies
  • Events outside our reasonable control

Where possible, we will provide notice and offer an appropriate rescheduled date, alternative service, credit or refund.

We are not responsible for losses caused by events outside our reasonable control, except where required by law.

22. Refunds and Credits

Refund and credit eligibility depends on:

  • The type of service
  • The applicable service agreement
  • The amount of notice provided
  • Whether trainer time or program capacity was reserved
  • Whether services have already been delivered
  • Whether costs have already been incurred
  • Applicable consumer-protection law

Approved refunds will normally be returned using the original payment method.

Processing times may depend on the bank or payment provider.

Credits:

  • Have no cash value unless legally required
  • Must be used before any stated expiry date
  • May not be transferred without written approval

Nothing in these Terms limits a refund or cancellation right provided by law.

Ontario does not provide a general right to return every product or service, but statutory refund and cancellation rights can apply to particular agreements and circumstances. (ontario.ca)

23. Gift Certificates and Promotions

Gift certificates, coupons and promotional offers may be subject to separate conditions shown when they are issued.

Unless otherwise stated, promotional offers:

  • Cannot be combined
  • Have no cash value
  • Apply only during the stated promotional period
  • May be restricted to selected services
  • Cannot be applied retroactively

Gift certificates will be administered according to applicable law and their stated conditions.

24. Online Training and Digital Materials

Online training, videos, documents, downloads and educational resources are provided for personal, non-commercial use.

Purchasing access does not transfer ownership of the content.

You may not:

  • Copy or redistribute materials
  • Share account credentials
  • Record or republish course content
  • Resell access
  • Remove copyright or branding
  • Upload materials to public websites or file-sharing services
  • Use the materials to operate a competing service

Online resources are educational and do not replace individualized veterinary, medical or behavioural advice.

Stop an exercise and seek appropriate assistance if it creates a health, welfare or safety concern.

25. Website Information

We make reasonable efforts to keep our website accurate and current.

However:

  • Service descriptions may change
  • Availability may change
  • Class dates may be updated
  • Prices may change
  • Website content may occasionally contain errors
  • External links may become unavailable

Website content is provided for general information and does not constitute a guarantee unless expressly confirmed in a service agreement.

26. Intellectual Property

Our website and its content are owned by or licensed to The Crunchy Canine Inc.

Protected content may include:

  • Graphics

  • Downloads

You may view the website and print limited material for personal use.

You may not reproduce, modify, distribute, sell or commercially use our content without written permission.

27. Reviews, Testimonials and Client Content

Where you submit a review, testimonial, photograph, video or other material, you confirm that:

Where you separately authorize public use, you give The Crunchy Canine permission to reproduce, edit for length, display and share the approved content for business and marketing purposes.

30. SMS Messaging Terms

30.1 SMS Program Description

The Crunchy Canine may use SMS text messaging to communicate with clients and prospective clients regarding:

  • Consultation follow-ups
  • Appointment confirmations
  • Appointment reminders
  • Schedule changes
  • Cancellations
  • Class and program information
  • Service updates
  • Training-related communication
  • Billing and payment notifications
  • General client communication
  • Occasional promotions, where separate promotional consent has been provided

30.2 Consent and Opt-In

You may opt in to receive text messages from The Crunchy Canine by:

  1. Providing your mobile telephone number through a consultation, registration, booking, contact or service-enquiry form.
  2. Reviewing the SMS consent disclosure presented with the form.
  3. Actively selecting the unchecked SMS consent checkbox.
  4. Submitting the form with your consent selection.
  5. Providing documented written or electronic consent through another method offered by The Crunchy Canine.
  6. Replying with an affirmative opt-in keyword where that option is offered.

The SMS checkbox will not be preselected.

Providing your telephone number alone does not automatically provide consent to receive ongoing promotional text messages.

Consent to receive promotional text messages is optional and is not a condition of purchasing a service.

30.3 Message Frequency

Message frequency varies depending on your enquiries, appointments, registrations and ongoing services.

You may receive messages as needed for:

  • Appointment confirmations
  • Appointment reminders
  • Schedule changes
  • Billing notices
  • Class information
  • Service-related communication

Where you separately consent to promotional text messages, you may receive up to four promotional messages per month.

Message frequency may temporarily increase where time-sensitive communication is required regarding an appointment, class or active service.

30.4 Message and Data Rates

Standard message and data rates may apply according to your mobile carrier and service plan.

You are responsible for charges imposed by your mobile-service provider for sending or receiving text messages.

30.5 Opting Out

You may opt out of SMS communication at any time by replying:

After receiving your STOP request, we may send one final message confirming that you have been unsubscribed.

Your opt-out request will be processed without delay and no later than 10 business days.

You may also request to stop receiving text messages by contacting us directly.

After opting out, you will not receive additional text messages unless:

  • You provide consent again
  • You specifically request a text response
  • A message is legally required

Where possible, necessary service communication will be provided by telephone or email instead.

30.6 Help and Support

30.7 17hats and Bandwidth

The Crunchy Canine uses 17hats to manage certain client records, workflows and communications.

SMS messages are supported through 17hats and its texting provider, Bandwidth.

17hats and Bandwidth may process information required to provide the messaging service, including:

  • Mobile telephone numbers
  • SMS opt-in records
  • Consent dates and methods
  • Message content
  • Message delivery information
  • Opt-out requests
  • Technical and security information

These providers may process or store information through their systems as necessary to operate the SMS service, deliver messages, maintain records, prevent misuse, provide support and meet legal obligations.

30.8 No Sale or Third-Party Marketing

The Crunchy Canine does not sell, rent or trade:

  • Mobile telephone numbers
  • SMS opt-in records
  • Consent information
  • Lead information
  • Client information

Mobile information and SMS consent will not be shared with third parties or affiliates for their own marketing or promotional purposes.

Text-messaging originator opt-in data and consent will not be provided to third parties except:

  • Service providers such as 17hats and Bandwidth that are necessary to operate and deliver the SMS service
  • Authorities or other parties where disclosure is legally required
  • Parties necessary to protect rights, safety, security or prevent fraud

No service provider is authorized by The Crunchy Canine to use mobile opt-in information for its own unrelated marketing.

30.9 Privacy

Personal information collected through SMS communication will be handled according to our Privacy Policy:

30.10 Changes to the SMS Program

We may update our SMS program or these SMS terms periodically to reflect changes in:

We will not materially expand promotional messaging beyond the consent you provided without obtaining additional consent where required.

Continued participation in the SMS program after a non-material update constitutes acceptance of the revised terms.

35. General Legal Provisions

Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed only to the extent necessary. The remaining Terms will continue to apply.

No Waiver

If we do not immediately enforce a provision, that does not mean we have waived the right to enforce it later.

Entire Agreement

These Terms, together with any applicable service agreement, registration form, waiver, invoice, booking conditions, facility rules and Privacy Policy, form the agreement concerning the applicable service.
